New Jersey v. Hughes

521 A.2d 1295 (1986)

Facts

The cashier at the office of the Courier Post in Cherry Hill was robbed at gunpoint of a large amount of cash by two men. D was indicted for robbery, possession of a weapon for an unlawful purpose, and conspiracy to rob. According to D, during the period of approximately one month before the robbery, he had been approached on a number of occasions by Tyrone Wolley who solicited him to take part in robbing the Courier Post. D rejected the invitation and answered Wolley that he was not interested in doing armed robberies. Approximately one or two weeks before the Courier Post robbery actually occurred, D visited Detective Beverly and told him of Wolley's solicitations. D did not suggest that he had agreed to join the enterprise and said that he told Wolley he would not do so. D was convicted of a conspiracy to rob. D appealed claiming in part that the trial court should have instructed on renunciation.
