Moody v. Blanchard Place Apartments

793 So.2d 281 (2001)

Facts

P resided with his two daughters in an apartment at D. P was cooking in a copper bottom pot on the back burner of the Stove and attempted to stir some noodles with a metal spoon. The strength of the current was so strong that it prevented Mr. Moody from immediately drawing away from the Stove. When P finally disengaged from the Stove (presumably when the circuit breaker was tripped), he stumbled backward and hit his head, neck and back on the opposite kitchen wall. P's two daughters were present and witnessed the incident. P sued D alleging that they were strictly liable for the defective Stove in their custody. P presented evidence that his past wages were $60,283, and lost fringe benefits were $7,234. P’s expert estimated lost future earnings to be $300,974. D’s expert calculated lost past wages to be $35,242 and lost future wages to be $27,012. The jury awarded P general damages in the amount of $150,000. Special damages in the amount of $60,000 were given for P’s lost past wages and $100,000 for his loss of future earnings. D appealed.
