Meyer v. United States

464 F. Supp. 317 (D. Colo. 1979)

Facts

Meyer (P) was told by a doctor that she needed her wisdom teeth removed. After the removal, she suffered great discomfort, and it was discovered that she had suffered lingual nerve damage. P sued the doctor for damages. The doctor testified that he had followed his standard procedures when dealing with P, and had given her the standard warning about the operation and the possibility of nerve damage. His testimony was supported by two of his assistants. P testified that she had received no warning.
