A Time magazine (D) article stated that congressman Daniel Flood steered government business to Medico Industries (P), which Rackets Boss Russell Bufalino frequented. P sued for defamation. D was granted summary judgment. D submitted two FBI documents which were supplemented with affidavits of two FBI agents. P appealed.
