Facts

P served with a request to admit that defendant McShain occupied or controlled the premises where a fatal accident occurred. P made that admission. During the trial, McShain read the admission to the jury and argued that McShain was a statutory employer and liable only for workmen's compensation benefits. After a verdict for P, McShain moved for a judgment notwithstanding the verdict.
