Facts

Maine and Braun (Ds) were accused of murder, two counts of kidnapping, forcible rape, and assault with intent to commit murder. They are strangers to the small community where they have been held for trial. Two of the victims were a popular teenage couple from respected families in the area and were assaulted under circumstances that would compel any community's shock and indignation. Ds motioned for a change in venue. The trial court denied that motion without prejudice to its renewal if the facts should so warrant. Ds now seek a writ of mandate to direct the court to change the venue.
