Facts

Lynch (P) consulted her gynecologist (D) as she had not had a menstrual period for other three months. After a cursory visual examination, D informed her she was not pregnant. D then prescribed the hormonal drug Provera without explaining any of the attendant risks. P became aware that the drug posed a serious risk of congenital defects in a child if ingested early during pregnancy. P took the drug, and when menstruation did not occur, she got a second opinion and found out that she was pregnant but fearing for the harmful effects from the drug, she elected to have an abortion which was against her personal, moral and religious convictions. P sued D for physical, psychological and emotional injuries.
