Lockett v. Ohio

438 U.S. 586 (1978)

Facts

Lockett (D) was the getaway driver in an armed robbery of a pawnshop. One of her accomplices accidentally killed the robbery victim. D was convicted of first-degree murder under the felony murder rule. D offered mitigating circumstances, claiming that she did not cause or intend to cause the victim's death. Since it was not a statutory mitigating circumstance, it was disallowed, and D was sentenced to death. D appealed.
