Facts

Linegar (P) was a highway patrol officer who was killed in the line of duty. His widow and children sued under products liability. P was killed during a routine traffic stop. None of the shots that hit his vest penetrated the vest or caused injury. The wounds P suffered from were all caused by shots that struck parts of the body not protected by the vest. The vests were purchased by the high way patrol and left an area along the side of the wearer exposed. This feature of the vest was obvious when the highway patrol purchased the units. The bullet that killed P entered into the side of his body in the exposed area. The jury verdict went to P and Armour (D) appealed.
