Less v. Taber Instrument Corp.

53 F.R.D. 645 (W.D.N.Y. 1971)

Facts

A deposition subpoena was served upon nonparty Teledyne, Inc., in New York. The subpoena stated that the corporate president was to come to New York for the deposition. The president of Teledyne was located in Los Angeles, the corporation's principal place of business. Teledyne moved to quash the subpoena or for a protective order. They argued that the director of a nonparty corporation must be personally subpoenaed in order to take a deposition.
