Facts

Lee (P) was a waitress at a steakhouse when she was injured when a Coca Cola bottle exploded in her hand. Evidence showed that the bottle exploded in P's hand and had not struck anything and that it had not been subjected to temperature extremes or mishandling. The trial judge refused to submit a claim based on strict tort liability. The verdict went to D and P appealed.
