Facts

P alleges that Chester Laster contracted pleural mesothelioma as a result of his exposure to and inhalation of asbestos dust and fibers while he was employed at the Philip-Carey/Celotex Plant from 1929 through 1970. Ps motioned under Rule 201 for the Court take judicial notice 'of the fact that asbestosis is a disease which is caused by the inhalation of asbestos dust and fibers.' D challenges the accuracy of the statement because its implication that asbestos causes asbestosis regardless of the physical characteristics of the fiber and the length of exposure.
