Minster (D) manufactured a press that delivered 60 tons of force for pressing die halves together. The unit was originally activated by a two-hand button tripping device in order to keep the operator’s hands away from the press. Toledo who purchased the press bought an optional foot pedal. Knitz (P) an employee of Toledo was a press operator. The foot pedal was in use, and P found it necessary to move the pedal and in doing so leaned on the bottom portion of the die with her hand. P's foot accidentally activated the foot pedal, and two fingers were amputated. Another safety device that would pull back the operators hands was not installed. Summary judgment was given to D. P appealed.
