Facts

Jorgensen (P) purchased a new motorhome from Pressnall (D). D assigned the resulting financing contract to Commercial Credit warranting the enforceability of the assigned contract. D assured P that any defects in the home would be fixed promptly. A list of defects was given to D, and the problems were never adequately solved. P decided to rescind the contract, and the home was eventually repossessed by Commercial and sold at a loss. The trial court found for P against D and for Commercial Credit on its cross-complaint against D. D appealed.
