Levi Strauss was first on the block with its '501' jeans. Jordache decided to create a line of jeans called Jordache Basics 101. Levi (P) claimed that the use of the '101' by Jordache (D) was a violation under the Lanham Act of its trademark. This resulted from P's opposition to D's filing for trademarks on Jordache 101, Jordache Basics 101, and Basics 101. P filed notices of opposition to each of these marks based on confusion. This court then heard the issue of the likelihood of confusion based on the Polaroid case to determine if summary judgment should be granted to either party.
