Facts

Appellants were a lesbian couple that wanted to get married. The clerk refused to issue a marriage license to them. The circuit court affirmed that decision and this appeal resulted. The claim was that their right to marry, their right to association and their right to the free exercise of religion had been violated and that the refusal to allow them to marry is cruel and unusual punishment.
