Facts

Bollinger fraudulently claimed to own over a million acres of land. Bollinger sold 230,000 acres to Croll (D) who paid in goods and with two bonds. Bollinger assigned the bond to Ludwick (P) and disappeared. P attempted to collect on the bond. D refused to pay because of Bollinger's fraud. P sued to collect. D filed a motion for nonsuit.
