Facts

P was injured at work. It is undisputed that on May 6, 1977, in consideration of the sum of $1,312.00 P executed a document, agreeing to release D from any claim arising out of the accident. That release specifically encompassed '* * * injuries not now known whether or not the undersigned has been advised by doctors or others in any way.' P sued D to recover damages under the Federal Employers' Liability Act (FELA). D moved for a summary judgment on the ground that the claim of the plaintiff is barred by an accord and satisfaction.
