Indiana State Symphony Society, Inc. v. Ziedonis

359 N.E.2d 253 (1976)

Facts

Ziedonis (P) was employed by Symphony (D) as a violinist. D was awarded a judgment of $6,335 as damages for his discharge in an alleged violation of his written employment contract. D appealed; the $3,430 that P was paid with two out of town orchestras should be deducted from the damage award. P contends that D failed to prove that these monies earned after the breach by D was a profit and that they failed to prove that he could not have earned this income had he not been discharged.
