In Re Lanza

Facts

Greene consulted Lanza (D) with respect to the sale of her residence. D also agreed to represent the Connollys, the purchasers of D's home. The closing date was moved back and then moved forward, but it was discovered that the purchasers were short $1,000 on the closing date that was moved forward. The buyers then suggested that the parties close title at the early date and that they give the seller a postdated check for the $1,000. D advised the seller that nothing was wrong with such an arrangement. The sale went to closing and when the check was tendered, it was returned for insufficient funds. The Buyers refused to make the check good in that they were told the cellar was dry at all times and they claimed that such was not the case and that they were keeping the $1,000 to rectify that situation. The seller contacted D who did nothing. The seller then retained her own attorney and sued the buyers. D was reported to the state bar.
