Imperial Ice Co. v. Rossier

18 Cal.2d 33, 112 P.2d 631 (1941)

Facts

Imperial Ice Company (P) acquired title to an ice distributing business that included a covenant for the original owner, Coker, not to compete. Subsequently, Coker began selling in the same territory, violating the contract. Coker was selling ice obtained from Rossier (D). P brought an action to restrain Coker from violating the contract, and D from inducing Coker to violate the contract. The trial court sustained a demurrer to the complaint. P appealed on the ground that the complaint did state a cause of action against D for inducing breach of contract.
