Hyatt v. People Ex Rel. Corkran

188 U.S. 691 (1903).

Facts

The Governor of Tennessee had requested that Hyatt (P) be extradited from New York because he had been indicted for the crime of false pretenses and was a fugitive from justice from Tennessee. There was no evidence that D committed the crime in Tennessee. D was only in Tennessee for one day eight days after the alleged crime was committed and then he left. D was present for purely business purposes; he had never been in the state. D's writ of habeas corpus was granted by New York's highest court. The state appealed.
