Guardianship Of Simpson

67 Cal.App.4th 914 (1998)

Facts

This case involved the infamous murder of Nicole Simpson and the subsequent guardianship established over Sydney and Justin, the children of Nicole and O.J. After the acquittal at the murder trial, O.J. requested termination of the guardianship. At the termination hearing, the guardians sought to introduce evidence regarding the circumstances of Nicole's murder; the trial court refused as the guardians waived that issue by not listing any murder witnesses on their witness list. A civil case was pending against O.J., and the trial court did not wait for the resolution of that case to determine the guardianship of the children. It was determined by the trial court that the guardians had to prove by clear and convincing evidence that it would be detrimental to return the children to their natural parent. The trial was held, and guardianship was terminated. This appeal followed.
