Gryc (P), a four-year-old child, was severely injured when her pajamas caught fire as she reached across an electric stove to shut off a timer. She was severely burned. At trial, it was shown that Riegel Textile Corp. (D), the manufacturer of the cotton material, was negligent in its manufacture of the material because it could have used flame retardant material. The material did meet all federal standards of safety. The jury awarded P $750,000 in compensatory damages and $1 million in punitive damages. D appealed the punitive damages.
