Facts

Griffith (P) rented a room for the purpose of viewing the Coronation Procession of June 26, 1902. The procession was rendered impossible due to an operation upon the King. The decision to cancel the procession was reached that morning at 10 a.m. on the 24th. The parties entered into the contract to rent the room at 11:00 a.m. that same day. The procession was to take place at 11:00 a.m. Neither contracting party was aware of the fact that the procession would not be taking place. P sued D for a refund.
