Facts

Greenbaum (P) was returning to work at the post office on his day off to get his paycheck when he slipped and fell and was injured. P sued United States (D) under the Federal Tort Claims Act for $200,000. Under FECA D is obligated to pay compensation for the disabilities of an employee for personal injuries sustained while performing his job. The FECA remedies are exclusive for anyone within its coverage. D claims that the court is without jurisdiction to hear P’s claim. D claims that there is a substantial question of whether an employee returning to work on his day off to get his paycheck he is covered by FECA.
