Facts

H sued his former wife on a contract that basically give him $300 per month until the parties no longer desired the payments to continue. The background to the agreement was that H did not want to quit his job but W wanted H to accompany her on her travels, and as such, she agreed to pay him the stipend. The agreement was executed 9-17-32 and the parties divorced on 9-11-33. There was no consideration in the writing itself. H now comes before the court in 1939 claiming that W still owed him $25,500 with interest at 5% per annum.
