Glickman v. Collins

13 Cal.3d 852 (1975)

Facts

Debra Collins (D) guaranteed the obligation of Gerald Glickman to make alimony and child support payments to P. The guaranty was executed after P and Gerald had separated D contends that the agreement is void as against public policy as it was intended to induce Gerald to divorce P. After the guarantee was executed, P and Gerald got a divorce, then Gerald married D. D then obtained a divorce from Gerald, and then Gerald stopped making payments required under the separation agreement. P got a judgment against Gerald for the arrearages, and that had not been satisfied. P then sued D under the guarantee. D contends that the guarantee is unenforceable as being contrary to public policy because it promoted divorce. Judgment was given to P and D appealed.
