Giacchetto v. Patchogue-Medford Union Free School District

293 F.R.D. 112 (2013)

Facts

P began working as an elementary education teacher for D in 1996. P was diagnosed with adult Attention Deficit Hyperactivity Disorder (ADHD). P claims that when she informed D, Dr. Tania M. Dalley repeatedly mocked P within earshot of others. P filed a complaint with the New York State Division of Human Rights (DHR) alleging disability discrimination. P alleges that she was treated differently from other employees who did not have a disability and who did not file DHR complaints. D issued her numerous counseling letters and transferred her to a different classroom and grade level against her will. P alleges that D refused to accommodate her disability. P is seeking 'compensatory, pension, medical benefits, emotional, physical, and punitive damages (where applicable), lost pay, front pay, interest, injunctive relief, and any other damages permitted by law. Pending before the Court is D's motion to compel P to provide authorizations for the release of all records from P's social networking accounts, including but not limited to her Facebook, Twitter, and Myspace accounts. D argues that information is relevant because it reflects her 'levels of social interaction and daily functioning' and her 'emotional and psychological state.' P argues that D's request is based on pure speculation and a fishing expedition 'designed to harass.
