Facts

A number of parties on both sides of the issue came to a settlement of asbestos tort actions. Those parties came before the court to certify the class, approve the proposed settlement, conclude that the class was adequately represented, and approve the adequacy of the notice program as implemented by the settling parties. The issues raised were the certification of the class of all future claimants and the conflict between counsel settling current damage claims and claims of those not yet damaged.
