Facts

Ferdinand (P) adopted a black child when she was married. However, P got divorced and had to support both the adopted child, herself, and another child from her marriage and to help in these tasks, P asked for adoption assistance and was denied by D in that she had refused such assistance before, and that amounted to a waiver. P filed this suit in court and asked for a permanent injunction and the payment of the benefits due. The trial court granted a TRO for the payment of the assistance until it made a formal ruling on the issue.
