Facts

Faber (P) was diagnosed as a manic-depressive. While in the various states of this mental disease, P did a lot of business and had plans to develop property with hotels, coops, and drug and merchandise marts. P was eventually hospitalized between transactions, and during this time frame, the issue of the validity of a contract he had entered into was challenged on the grounds that P was incompetent to contract. The testimony of the experts was in conflict. The issue before the court was the mental state when incompetency to contract had been reached.
