Facts

On August 16, 1965, Brites conveyed property to the Bible Baptist Church whose pastor is a realtor. After learning of the conveyance, Ps in the original suit wrote a letter to the Church attention Davis (D) reciting certain deed restrictions recorded in the County, enclosing a copy of a TRO against Brites with a statement that they would be forced to file an injunction if D did not enforce the deed restrictions and placed a church structure on the property. On April 28, 1971, D moved a structure to be used as a church building onto the property. D refused to remove the structure and was held in contempt of a TRO issued May 16, 1962, fined and ordered to jail until the building was removed. This appeal resulted.
