Estate Of Lopez

79 Cal.App.2d 399 (1947)

Facts

The court split attorney and trustee fees between the income beneficiary and the remainder corpus. The appellant contends that the trustee may not impair the principal of the trust estate by paying therefrom compensation for itself and its attorneys and that such amounts must be paid by income. The testamentary provisions in the trust somewhat supported that interpretation with a formula for producing net income.
