Estate Of Burton F. Blough

378 A.2d 276 (1977)

Facts

Blough (Testator) executed a will that took effect on his death 16 months later. Blough made specific bequests to his wife and his only child with the residuary to be placed in trust. The income from that trust was to be paid to his wife and daughter, and any remainder left after the death of the wife and daughter should be distributed among her children and if the child or children were deceased to her grandchild or grandchildren. The wife died in 1944, and the daughter became the sole beneficiary. She had only one child who died without issue in 1974. The granddaughter's will bequeathed her residuary estate to appellee. The daughter then filed a petition for termination of the trust. This was opposed by the testator's brother and sister. The court terminated the trust. This appeal followed.
