Facts

During Dowling's (D) trial for various offenses arising out of a bank robbery, the trial court admitted the similar act evidence of Ms. Henry, who testified that a man, whom she later identified as D, had attempted to rob her home. Although D was acquitted of her charges, this evidence was admitted over D's claims that its admission was prohibited by the Double Jeopardy and Due Process Clauses. D appealed his conviction.
