Facts

DelCostello (P) and another employee sued their respective employers (D) and unions (D1) for breach of a collective bargaining agreement and a failure to adequately represent them respectively. The issue in these actions was as to the proper statute of limitations for the actions. The court of appeals dismissed the suits when it applied the state statutes. P appealed.
