Davies v. Martel Laboratory Services, Inc.

545 N.E.2d 475 (1989)

Facts

Davies (P) alleged that Martel (D) hired her in April 1980 to perform oil analysis and mapping work until March 1, 1983. In the latter part of February 1983, P attended a dinner with D’s president, and at that time, P was made an offer from D to alter, change, and modify the terms of her employment contract. P was to be made a vice president of D earning $40,000 per year if she would obtain an MBA degree. If she accepted the offer, she would immediately be designated a permanent employee of D and appointed to the President’s Council. P was also promised ½ the expenses of her obtaining the degree. P immediately accepted the offer. In the fall of 1983, she enrolled at Northwestern. P attended the President’s Council meetings and assumed additional duties and responsibilities as a policymaker at D. On October 12, 1984, D terminated her employment without cause. P sued D, and her amended complaint was dismissed. P appealed.
