Facts

Daniels (D) entered a building through an open outer door that was inadvertently left open. Once inside, D opened the doors to an inner apartment to get into several rooms. D stole a great number of postage stamps belonging to the Western and Atlantic Railroad Co. At trial, the judge instructed the jury that an inner breaking would suffice even if there was no breaking of the outer door. D appealed his conviction for burglary.
