Facts

Curtis (P) a passenger was killed instantly when Finneran (D) the driver of the car fell asleep at the wheel. P sued D for wrongful death. The complaint sought reimbursement for funeral expenses and the net pecuniary loss suffered by P's surviving children. Expert testimony was given as to the expected estate and future earnings of P, but the trial court considered that evidence too speculative. The verdict was for P, and the children received $53,394, and the trial court did not give its reasons for those amounts. P motioned for a new trial but was denied. P appealed.
