Facts

Mitchneck (D) owned a coal mine. He agreed with a store owner to deduct from his employee's pay the money used to buy goods. He would then turn this money over to the storekeeper. D withheld the money but didn't give it to the storekeeper. He was convicted of fraudulent conversion. D appealed, claiming that his actions constituted a civil, not a criminal breach.
