Facts

D was charged with receiving stolen goods. The case was tried before a jury, and the trial court charged the jury on the requirements for a conviction. The court instructed the jury that the crime was 'the acquiring of goods knowing them to have been stolen, or under such circumstances as would lead a man of reasonable prudence to suspect that they were stolen.' D was convicted and appealed.
