Coggs v. Bernard

2 Ld. Raym. 909, 92 Eng. Rep. 107 (K.B. 1703)

Facts

Bernard (D) moved casks of brandy owned by Coggs (P) from one place to another. D did the act gratuitously. Through D's negligence, some of the casks were broken, and a large amount of brandy was lost. P sued D for the amount of brandy lost. P received judgment. D appealed, claiming that he was neither a common porter nor received any reward or consideration.
