Childs v. United States

923 F.Supp. 1570 (S.D. Georgia 1996)

Facts

A postal truck wrongfully entered an intersection and struck Ps’ car and pushed that car into another truck. Ps, (Ashley, Debra, and Debra’s unborn child, General) died almost immediately after the collision. Ps sued under the Federal Torts Claims Act, 28 U.S.C. 2671 seeking damages for Ps’ wrongful death, and funeral and medical expenses. The Government admitted that it was vicariously liable for the negligent acts of its employee who operated the truck. The parties stipulated to the medical, funeral, and car expenses. The only question to be resolved by the court was the damages to Ps’ wrongful death claims.
