Facts

Village 2 at New Hope, Inc. (D) was a developer of property. It petitioned the Borough of New Hope to amend its comprehensive zoning ordinance to accommodate the development of PUDs. The New Hope Planning Commission approved the zoning. Building permits were issued to D. Cheney (P), and other neighboring landowners didn't want these PUDs in their neighborhood. P appealed to the board, who affirmed the issuance to D. P then appealed to the Bucks County Court of Common Pleas, which reversed the board's decision. It held that the ordinances were invalid because they failed to conform with a comprehensive plan because too much discretion was vested in the Planning Commission.
