Facts

The defendant, Chaplin, and his wife were engaged in the wine and liquor business. They proposed to Violette McMullen that if she would advance money, they would purchase liquor stamps with the money and return the money advanced, relying on the defendant's promise. McMullen gave the defendant money. However, Chaplin did not purchase liquor stamps with the money nor did he later return the money. Chaplin was convicted of obtaining money by false pretenses.
