Facts

Garret F. (P) was severely injured in a motorcycle accident. He was paralyzed from the neck down from age four. However, his mental abilities remain unaffected. He is able to speak, and to control his motorized wheelchair and to operate a computer device that responds to head movement. P is currently a student in Cedar Rapids (D), and his academic performance has been a success. P is ventilator dependent and requires a responsible individual nearby to attend to certain physical needs while he is in school. In 1993, P's mother requested D to provide those special services. D denied the request believing that it was not legally obligated to provide continuous one on one nursing services. The matter was sent to an administrative law judge, and that judge determined that D was responsible for providing the requested services.
