Facts

D was tried, and at the end of the trial, D requested a jury instruction that D was not compelled to testify and the fact that he does not cannot be used against him as an inference of guilt and should not prejudice him in any way. The trial judge refused, and D was convicted and appealed. The Supreme Court of Kentucky found no error.
