Brown v. Brown

611 N.Y.S.2d 65 (1994)

Facts

H held an Investment Maintenance Account with Chase Lincoln First Bank. The account was H’s separate property. The account was defendant's separate property, and the Appreciation in the account during the marriage was not due to H's efforts but, rather, was due to the bank's management of the account, market forces, and the 1984 deposit of an inheritance from H's father. The court awarded W 25% of the appreciation in the account. H appealed.
