Facts

D was convicted in an Illinois state court of criminal contempt and sentenced to imprisonment for 24 months for willfully petitioning to admit to probate a will falsely prepared and executed after the death of the putative testator. D made a timely demand for jury trial which was refused. The Illinois Supreme Court affirmed. The Supreme Court granted certiorari.
